1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the website located at www.wildmoonmidwiferync.com (the "Site"), owned and operated by Wild Moon Midwifery & Women's Health ("Wild Moon Midwifery," "we," "us," or "our"), located at 1627 Pine Harbor Way, Leland, NC 28451. By accessing or using the Site, scheduling a consultation through the Site, or otherwise interacting with our online services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
 

2. Educational Content Only — No Medical Advice

All content on the Site, including blog posts, service descriptions, and FAQs, is provided for general informational and educational purposes only. It is not intended to be, and should not be treated as, medical advice, and it does not create a provider-patient relationship between you and Wild Moon Midwifery, Casey Hartell, DNP, CNM, WHNP, or Tamera Cole, CPM. Reading content on the Site does not make you a client or patient of Wild Moon Midwifery.

A provider-patient relationship is established only after you have completed our intake process and formally enrolled in care, which includes review and signature of our Informed Consent Disclosure and related practice documents.
 

3. Emergency Disclaimer

This Site is not monitored for emergencies and should never be used to report or manage a medical emergency. If you or someone you know is experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
 

4. Scheduling a Free Consultation Through Calendly

Wild Moon Midwifery uses a third-party scheduling tool, Calendly, to allow prospective clients to book a free introductory home birth consultation. Please read this section carefully before submitting any information through our scheduling tool.
 

4.1 Calendly Is Not HIPAA-Compliant

Calendly has not signed, and Wild Moon Midwifery does not have in place, a Business Associate Agreement (BAA) with Calendly. As a result, Calendly is not an appropriate or HIPAA-compliant channel for transmitting Protected Health Information (PHI), and Wild Moon Midwifery does not treat information submitted through Calendly as PHI.
 

4.2 What This Means for You

• Any information you enter into the Calendly scheduling form (such as your name, email address, phone number, or a general reason for your inquiry) is collected before any provider-patient relationship exists and is used solely to schedule your free consultation.

• Do not enter medical history, symptoms, diagnoses, medications, due dates tied to clinical detail, or any other sensitive health information into the Calendly scheduling form or any related notes/comments field.

• By submitting the Calendly scheduling form, you acknowledge and agree that: (a) you understand Calendly is not HIPAA-compliant and is not covered by a Business Associate Agreement with Wild Moon Midwifery; (b) the information you submit through Calendly is not considered Protected Health Information; and (c) you agree to limit what you submit through Calendly to basic contact and scheduling information only.

4.3 If You Would Prefer Not to Use Calendly
 

If you are not comfortable submitting information through Calendly, or if you need to share medical history or other health information before your consultation, please contact Wild Moon Midwifery directly instead of using the online scheduler:

5. Fees and Payment

Our global fee for pregnancy, birth, postpartum, and newborn care, along with our deposit, monthly payment, and refund terms, are described in detail in our Informed Consent Disclosure, which is reviewed and signed separately once you enroll in care. Fee information on the Site is provided for general reference and is subject to the terms of your signed Informed Consent Disclosure, which controls in the event of any conflict.
 

6. No Guarantee of Acceptance as a Client

Submitting a consultation request or completing a consultation does not guarantee acceptance as a client of Wild Moon Midwifery. Wild Moon Midwifery maintains limited monthly capacity and clinical candidacy criteria for home birth, and reserves the right to decline or discontinue care consistent with applicable law and professional standards.
 

7. Intellectual Property

All text, graphics, logos, and other content on the Site are the property of Wild Moon Midwifery or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.
 

8. Third-Party Links and Tools

The Site may link to or embed third-party tools (including Calendly) and third-party websites. We do not control and are not responsible for the content, privacy practices, or terms of third-party sites or tools. Your use of any third-party tool is governed by that provider's own terms and privacy policy in addition to these Terms.
 

9. Testimonials and Reviews

Any testimonials or reviews displayed on the Site reflect the individual experiences of the clients described and are not a guarantee of similar results for any other client.
 

10. Limitation of Liability

To the fullest extent permitted by North Carolina law, Wild Moon Midwifery and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Site or any third-party tool linked from or embedded in the Site.
 

11. Indemnification

You agree to indemnify and hold harmless Wild Moon Midwifery, its owners, employees, and contractors from any claims, damages, or expenses arising from your misuse of the Site, including submission of Protected Health Information through a non-secure channel contrary to Section 4 of these Terms.
 

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Brunswick County or New Hanover County, North Carolina.

13. Changes to These Terms
 

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
 

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
